Terms of Service

Kenora Web Solutions is operated by Lowcl Enterprises Inc., based in Kenora, Ontario. By using this site or hiring us, you agree to the terms below. We've kept this in plain English. The intent is fairness, not gotchas.

Using the site

Browse freely. Don't try to break it, don't copy our content for use elsewhere, and don't use it for anything illegal. The site is provided as-is - we keep it accurate and up to date but make no promises about uptime.

The service

Our primary service is Managed Presence - ongoing management of your website and core online presence for $395 CAD per month. The starting point is a free Customer Path Test, which carries no obligation. Additional services (such as customer-capture systems) are recommended only when the Customer Path Test shows a genuine need, and are quoted separately.

Two setup options are available for Managed Presence: month-to-month with a $1,250 setup fee, or a 12-month agreement with no initial setup fee. If the 12-month agreement ends early, the unpaid portion of the setup fee becomes due as described in the service agreement. Managed hosting is available for $50/month when required.

How we work

You have one accountable local point of contact who owns the relationship. A coordinated specialist team handles development, maintenance, monitoring and reporting under confidentiality agreements. You deal with us, and we take responsibility for the work - you do not manage multiple contractors.

We respond to email within one business day. We guarantee the agreed work and the care of the system. We do not guarantee specific Google rankings, leads or revenue - anyone who does is not being honest.

Invoicing

We invoice through Wave. Pay by credit card or Canadian bank transfer. Invoices are due on receipt. Late payments accrue 1.5%/month after 14 days; over 30 days overdue and we may pause work until you're current. Fees are in Canadian dollars.

Showing your work

Unless you tell us otherwise in writing, we may list you as a client and link to your live site in our portfolio.

Cancellation

Month-to-month plans can be cancelled with the notice required in the service agreement. The 12-month agreement has specific terms if it ends early, as described in the agreement. We will always refer to the service agreement so the details are clear.

We can end an engagement with reasonable notice. If we do, we'll refund any prepaid work we haven't done and hand off your files.

Limits

To the extent allowed by Ontario law, our total liability for any claim is limited to what you've paid us in the past 12 months, or $5,000 CAD - whichever is less. We're not liable for indirect or consequential damages (lost profits, lost data, etc.). This doesn't apply to fraud or anything else law won't let us limit.

Disputes

These terms are governed by Ontario law. Before going to court, both sides agree to try to sort it out by direct conversation first. We're a small business and you're presumably a small business - let's behave like neighbors.
